These Terms of Use (“Terms”) constitute an agreement between Bebo’s Tire Center (“Bebo’s Tire Center,” “Bebo’s Tire,” “we,” “us,” or “our”) and you. You must immediately notify Bebo’s Tire Center regarding any unauthorized use of your access credentials or any other concerns that you have about the misuse or security of your account by using the contact information listed below.

Intellectual Property

The Site, its content, any materials downloaded, and all intellectual property pertaining to or contained on the Site (including but not limited to copyrights, patents, database rights, graphics, designs, text, logos, trade dress, trademarks, and service marks) are owned by Bebo’s Tire Center. All rights, title, and interest therein shall remain the property of Bebo’s Tire Center and/or such third-party owner, as applicable. All content is protected by trade dress, copyright, patent, and trademark laws, as well as various other intellectual property and unfair competition laws.

Online Purchases and Other Terms and Conditions

All purchases through our Site or other transactions for the sale of goods formed through the Site, or resulting from visits made by you, are governed by our Invoice Terms and Conditions, which are hereby incorporated into these Terms.

Indemnification

You agree to defend, indemnify, and hold harmless Bebo’s Tire Center, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, your Submissions, any use of the Site’s content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Site.

Submissions

Any questions, comments, feedback, suggestions, ideas, improvements, plans, notes, drawings, original or creative materials or other information submitted to Bebo’s Tire Center via the Site (collectively, “Submissions”) shall be deemed and remain the property of Bebo’s Tire Center, and Bebo’s Tire Center shall be free to use, for any purpose, any idea, concept, know-how, or technique contained in the Submission a user of the Site provides Bebo’s Tire Center through the Site. Any computer system or other electronic device, whether it is yours, an Internet service provider’s, or Bebo’s Tire Center’s, can experience unanticipated outages or slowdowns or have capacity limitations.

Protecting Your Devices and Account

Although we are committed to protecting the privacy of your information, please do your part to protect your information by keeping your software patched, using updated anti-virus or anti-malware software, using personal firewalls, and an updated unique complex password. Bebo’s Tire Center makes no warranty whatsoever to you, express or implied, regarding the security of the Site, including with respect to the ability of unauthorized persons to intercept or access information transmitted by you through the Site. You acknowledge and agree that you are solely responsible for maintaining the security of your devices. Severability/No Waiver

If any provision of the Terms shall be deemed unlawful, void, or unenforceable for any reason, then such provision shall be deemed severable from the Terms and shall not affect the validity and enforceability of any remaining provisions. Bebo’s Tire Center’s failure to enforce the strict performance of any provision of the Terms or the terms and conditions of any other agreement that you enter into with Bebo’s Tire Center through your use of this Site for any Service will not constitute a waiver of our right to subsequently enforce such provision or any other provisions of the Terms or the terms and conditions of any other agreement that you enter into with Bebo’s Tire Center through your use of this Site.
